1. Scope of Application

These Terms and Conditions (GTC) apply to all orders placed through our online shop. Our offer is aimed at customers in Switzerland and Liechtenstein (as well as internationally, where selectable during the checkout process).
By confirming an order, the customer agrees to these GTC. Any conflicting or deviating terms specified by the customer shall not be recognized unless we have expressly agreed to their validity in writing.

3. Offer and Conclusion of Contract

 

1. The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order (non-binding online catalog).

2. By clicking the button to complete the order with payment obligation, the customer places a binding order for the items contained in the shopping cart.

3. The confirmation of receipt of the order is sent together with the acceptance of the order immediately after submission via an automated email. The purchase contract is concluded upon receipt of this email confirmation.

4. Prices and Shipping Costs

 

1. All prices are quoted in Swiss Francs (CHF).

2. As this is a sole proprietorship, value-added tax (VAT) is not separately itemized unless required by law and is included in the final price.

3. Shipping costs are added to the specified product prices. The exact shipping costs are clearly displayed to the customer during the checkout process before the binding order is submitted.

5. Delivery Terms and Availability

 

1. Delivery is made to the shipping address specified by the customer.

2. Unless otherwise stated in the offer, the standard delivery time within Switzerland is generally 14 business days. For exclusive drops, pre-orders, or special collections, delivery times may vary and will be indicated accordingly on the respective product page.

3. If a ordered product is unavailable because our suppliers fail to deliver without fault on our part, we reserve the right to withdraw from the contract. In this event, we will inform the customer immediately and refund any payments already received (in the form of a store voucher or via the original payment method).

6. Payment Terms

The customer has access to the payment methods specified during the checkout process (e.g., TWINT, credit card, Apple Pay, PayPal).
Payment of the purchase price is due immediately upon conclusion of the contract.

7. Retention of Title

The delivered goods remain the property of HE ROSE ON THE III. until full payment has been received.

8. Inspection Duty, Notice of Defects, and Warranty

 

1. The customer is obliged to inspect the delivered goods immediately upon receipt and to report any defects or deviations in writing via email to our customer support within 7 calendar days at the latest.

2. Hidden defects must be reported immediately upon discovery.

3. In the event of justified defects, we reserve the right, at our discretion, to repair the item, supply a defect-free replacement, or refund the purchase price in the form of a store voucher or via the original payment method.

4. The warranty excludes damage caused by improper handling, normal wear and tear, improper care (e.g., incorrect washing/ironing), or external influences.

9. Right of Return & Refunds

 

1. In Switzerland, there is no statutory right of revocation for online purchases. However, we grant our customers a voluntary right of return within 7 days of receiving the goods.

2. The prerequisite for return is that the item is unworn, unwashed, in its original condition, with all tags attached, and in its original packaging.

3. The customer bears the shipping costs for returns, unless the return is due to an incorrect delivery or manufacturing fault on our part.

4. Hygiene items, worn clothing, discounted items, or custom production runs (e.g., limited drops/special editions) are excluded from the right of return, provided this was indicated on the product page.

5. Form of Refund: In the event of an accepted return, the purchase price will be refunded exclusively in the form of a store voucher (store credit) that can be redeemed for future purchases on www.heroseonthethird.ch. Cash payouts or refunds to the original payment method are excluded (except where legally required due to major manufacturing defects).

10. Liability

We are only liable for damages caused by intent or gross negligence. Liability for slight negligence, indirect damages, consequential damages, or lost profits is expressly excluded to the extent permitted by law.

11. Copyright and Intellectual Property

All designs, trademarks, logos, graphics, text, and content on www.heroseonthethird.ch as well as goods from HE ROSE ON THE III. are protected by copyright. Any use, reproduction, or distribution without explicit written permission is prohibited.

12. Data Protection

The collection and processing of personal data is carried out in accordance with the provisions of the Swiss Federal Act on Data Protection (FADP/DSG). Detailed information can be found in our separate Privacy Policy on the website.

13. Final Provisions & Jurisdiction

​

1. Swiss law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

2. Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.

3. Place of jurisdiction for all disputes arising from or in connection with these GTC is, to the extent legally permissible, the registered location of HE ROSE ON THE III. (Canton of Zürich, Switzerland).
